How Much time it take for Divorce by Mutual Consent ?

It depends, if you are already living separately for more than 1 year then your advocate can make application for waive off for 6 months cooling off period which is mandatory in case of Divorce by Mutual Consent, in that case you may get divorce within 2 or 3 months otherwise it will take around 6 to 8 months.

Procedure for Mutual Consent Divorce :

  • Filing of Petition for Divorce by Mutual Consent along with required Documents
  • You have to present in court for 5 to 6 dates ( For Filing Petition, for counseling session and before Hon’ble Family Court)
  • At the end Hon’ble Family Court will Grant Divorce by Mutual Consent.

Application/Petition for Mutual Consent Divorce

Based on details provided by you, your Advocate will prepare your Application/Petition for Mutual Consent Divorce, with Application/Petition you have to provide following Documents

Documents Required for Mutual Consent Divorce: ­

Passport size Photo ( of Both parties)
Photo of your Child (If applicable)

1) ID proof of both the Parties.

2) Marriage proof 
Minimum two documents mandatory

  • Marriage Registration Certificate
  • Invitation Card
  • Marriage Photograph
  • Affidavit of blood relative

3) Residential proof
Any one of Following

  • Passport
  • Adhar Card
  • Election Card
  • any other permissable documents

4) Additional Documents if required (if applicable)

  • Birth Certificate of  minor child.
  • Registered document for transfer of property.
  •  Copy of receipt if articles, jwellery, or utencils are exchanged.
